new phone damged

I have received my new phone today and there is a chip on the glass of the camera array.

I spoke to an agent on chat who said I need to return it at my expense. This seems completely wrong and I believe is in breach of the consumer protection act.

Its not only the cost that's the issue but the fact if I am sending it to them it becomes my responsibility if anything happens. I   have done a quote with DPD, who they send with and to post it back to them fully insured it would cost £74.99!

Has anyone else had experience with this?
