Why have I received a final bill within cooling off period for an unused SiM?

Incorrect contract issued, support requested me to return phone and contract would be cancelled - it was well within 14 days.  SIM was never activated and was destroyed as requested.  Under the consumer rights act, cancellation within the cooling off period should have no cost to the customer, yet I had to pay to return the phone (support advised me I must), and have now received a bill for an unused SIM.  

Please advise, as both appear to be in breach of the Consumer Rights Act.

The SIM card would be activated upon dispatch, that’s when charges begin.

 

Return postage would be the responsibility of the party returning the item(s).

 

Nothing appears to have been done or advised incorrectly here.

No chargeable calls, texts or data were used, so this is unreasonable as is within cooling off period.  I will raise the matter further, as this practice is unethical and detrimental to the customer.

Hey there ​@f21970, sorry you feel this way. Whether used or not, the line-rental was opened, which you’d remain liable to pay for.

 

You would only be liable for the days the line-rental is opened for, not the whole monthly payment.

 

What was your reasoning for leaving us/returning please?

I have now removed all my handsets from you, not just the recently ordered one, which was meant to be an upgrade, however was not processed as such.  Due to that, it cost me to return it and for unused line rental.  For security, I find it surprising that the sim is shipped activated, and line rental should not be charged from point of dispatch, but only at point of activation, which did not take place.  I would like confirmation that the SiM was shipped as activated and therefore cost ID Mobile the fees that are being passed on to the consumer.

My business will henceforth be taken elsewhere, and I will not be returning.  I would like to raise a dispute regarding these charges please.

I am still awaiting refund of monies paid for the handset which was returned. I received no confirmation of receipt of this, however can only assume that it has been as the contract has been cancelled within the cooling off period.

I have the details of how much is allegedly “owed” and will be in touch with Trading Standards after I have enjoyed the holiday period.
